Introduction
These Terms and Conditions establish the legal framework for the relationship between House of Rouh AG and our clients. They are designed to ensure clear communication, protect both parties, and maintain the highest standards of professional service. By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these terms.
House of Rouh AG reserves the right to amend or supplement these General Terms and Conditions at any time. Any such amendments or supplements shall be communicated to the patient. If the patient objects to these changes in writing within 30 calendar days, the previous General Terms and Conditions shall remain in effect until the end of the contractual term. The patient shall not derive any rights from any amendments to these Terms. The current contractual provisions are available for review at www.houseofrouh.ch/agb at all times.
Any modifications or ancillary agreements shall only be effective if agreed upon in writing by both parties.
1. Scope of Contractual Relationship
1.1 The contract between House of Rouh AG and the patient is concluded upon the booking of a service or the purchase of a subscription via the platform or on-site at House of Rouh AG, as well as through the corresponding confirmation by House of Rouh AG (in the case of online bookings).
1.2. House of Rouh AG offers a range of services and subscriptions in the areas of osteopathy, massage therapy, physiotherapy, nutrition counseling, art therapy, breathwork, yoga, shiatsu, coaching, Reiki, and eye examinations.
1.3. The scope of services related to the offered services and subscriptions is determined by the details provided on the website or on-site at House of Rouh AG, as well as the service or subscription booked.
1.4. These General Terms and Conditions (hereinafter referred to as "GTC") govern the legal relationship and treatment contract between House of Rouh AG and the patient (hereinafter referred to as "the patient").
1.5 These GTC apply in their current version at the time of the treatment. They exclusively regulate the business relationship concerning the booked treatment (hereinafter referred to as "the treatment"), unless otherwise stated or agreed.
2. Cancellation Policy
2.1 Booked treatment appointments and seminars are generally binding.
2.2. The patient is required to inform House of Rouh AG as early as possible, but at least 48 hours in advance, in case they are unable to attend. Cancellations must be made online or via email. Cancellations cannot be accepted by phone.
2.3 Group/private classes must be cancelled no later than 12 hours before the class. Cancellations must be made online or via email. Cancellations cannot be accepted by phone. House of Rouh AG reserves the right to cancel classes in the event of insufficient participants. The patient will be offered an alternative appointment.
2.2. In case of late cancellations, failure to cancel, or non-attendance, House of Rouh AG will charge the patient the full amount of the scheduled service. This charge is not eligible for insurance reimbursement.
2.3. House of Rouh AG reserves the right to change or cancel booked appointments for good cause.
3. Payment Terms
3.1 Payment Due at Each Session

Clients are required to pay for each therapy session on-site immediately after receiving the treatment.

We prefer cashless payments. Payments can be made via common Debit-/Credit Cards, Postcard or Twint.

All fees are due regardless of insurance coverage.
3.2 Insurance Reimbursement Receipt ("Rückforderungsbeleg")

If applicable, clients will receive an insurance reimbursement receipt after payment.

It is solely the client's responsibility to submit this receipt to their health insurance provider for potential reimbursement.

House of Rouh AG does not guarantee reimbursement from the insurance provider and bears no responsibility for denied claims.
3.3 Payment Refusal by Insurance Providers

Insurance providers or health insurance companies may refuse to cover treatment costs. The patient assumes complete responsibility for all charges incurred regardless of insurance coverage.

The patient is responsible for taking all necessary steps to protect themselves against payment refusals or reimbursement claims. The following measures can help:

If there is any uncertainty about whether the therapy, medical training therapy, or similar treatments will be covered, the patient should obtain cost approval ("Kostengutsprache") from their health insurance provider through their doctor.

The patient should carefully review all invoices and promptly notify House of Rouh AG of any discrepancies.

3.4 Introductory Offers

All introductory offers are for first time clients only.
These GTC shall also apply to introductory offers, where applicable.3.5 Class Packages

Packages cannot be placed on hold unless for pregnancy or other imminent health (e.g. with attestation) reasons. The suspension will only occur upon submission of a written attestation, and the period will be agreed upon in mutual consultation with House of Rouh AG. The suspended period will be appended to the end of the subscription's validity.

Class Passes are valid for their stated valid amount. If unused or partially used services or subscriptions are not fully utilized, any claims will be subject to a 5-year limitation period. However, no cash compensation will be provided for such claims.

All class purchases are non-refundable, non-transferable, and non-shareable.
3.6 Pricing

Pricing as well as subscriptions and expirations can be seen on our website www.houseofrouh.ch. We reserve the right to change prices at any time.

For existing patients, the prices published on the website at the time of booking apply.
3.7 Non-Payment

If a client fails to make payment on-site, House of Rouh AG reserves the right to deny future appointments until outstanding payments are settled.
If payment is not made immediately after the treatment, the customer will be considered in default without the need for a reminder. House of Rouh AG reserves the right to charge a reminder fee of CHF 30.00 in addition to default interest. House of Rouh AG also reserves the right to pursue further claims.
4. Treatment
4.1 The treatment of the patient follows the generally recognized and established standards and guidelines.
4.2 Results may vary between patients. Individual factors such as patient compliance, pre-existing conditions, and biological differences can significantly impact treatment outcomes.
4.3 As is inherent in therapeutic and medical treatments, a specific treatment outcome cannot be guaranteed.
4.4 Physical treatments may involve certain risks including temporary discomfort, soreness, or in rare cases, exacerbation of symptoms. Patients should immediately report any unusual or concerning reactions to their therapist.
5. Classes and Appointments
5.1 Arriving for class

You must arrive at least 5 minutes before the class start time or your reserved place may be offered to a waiting client.

We cannot admit latecomers.
5.2 Waitlists

If you are added to the waitlist when booking and a space becomes available, you will automatically be enrolled in the class/seminar from the waitlist. The contract will be validly formed upon your addition to the class.

You will receive an email notification. Please add 'welcome@houseofrouh.ch' to your emails safe senders list to stop automatic emails going into spam.
6. Liability
6.1 Use of the services provided by House of Rouh AG is at the user's own risk. To the extent permitted by law, House of Rouh AG shall not be held liable for any direct or indirect damages.
6.2 House of Rouh AG particularly assumes no liability in the event of concealment of any physical or mental illnesses that make participation in the classes, appointments and workshops seem inadvisable.
6.3 Each participant is responsible for adequate insurance coverage. House of Rouh AG cannot be held liable for theft or loss of items.
7. Ability to Participate, Own Responsibility
7.1 Existing mental or physical limitations or an existing pregnancy must be reported to the therapist and the course management at the latest at the beginning of the therapy/course/workshop/event.
7.2 Should a health restriction or pregnancy occur during the course/event/workshop, the course management must be informed immediately.
7.3 If you have any doubts about your health or mental fitness, we recommend that you seek the appropriate expert advice before registering. In the case of acute physical or psychological problems, a doctor should be consulted beforehand to determine whether our therapies/seminars/classes offered make sense.
7.4 Our classes can have healing effects on the physical and mental condition, however, it is the participants’ responsibility to consult with a physician for guidance in case of uncertainty.
7.5 The therapist and the course management reserve the right to refuse clients and participants if the organiser is of the opinion that the health or psychological requirements for participation in the event are not met. This refusal can also be expressed at short notice or during ongoing courses. In this case, the course costs will be reimbursed pro rata. There will be no reimbursement if the refusal could have been avoided by the client’s fulfilment of their information obligations as stated in paragraph 7.1 – 7.4.
8. Force Majeure
8.1 House of Rouh AG shall not be liable for any delay or failure to perform any obligation under these Terms and Conditions due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, wars, civil disturbances, labor disputes, government orders or any other event of force majeure.
8.2 In such circumstances, House of Rouh AG reserves the right to cancel or postpone scheduled appointments, classes, or events, and will endeavor to provide reasonable notice to affected clients.
9. Intellectual Property
9.1 All content, materials, methodologies, treatment protocols, and educational resources provided by House of Rouh AG during treatments, classes, workshops, or events remain the exclusive intellectual property of House of Rouh AG.
9.2 Clients and participants are prohibited from reproducing, distributing, modifying, creating derivative works of, publicly displaying, or otherwise using any such materials without the explicit written consent of House of Rouh AG.
9.3 Any unauthorized use of House of Rouh AG's intellectual property may result in legal action.
10. Jurisdiction and Applicable Law
10.1 The jurisdiction for disputes arising from or in connection with this contract is Zurich, Switzerland, unless a mandatory statutory jurisdiction applies.
10.2 The applicable law is exclusively Swiss law, excluding conflict-of-law rules.
11. Data Protection
11.1 The personal data provided by patients is used solely for the purpose of fulfilling the contract and in accordance with the applicable data protection regulations. Further information can be found in our privacy policy at www.houseofrouh.ch.
12. Final Provisions
12.1 Should any provisions of these General Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid points, the statutory regulation shall apply, if available.
